What is Spousal Maintenance?


An application can be made by a person for support from his or her ex-partner after separation. This is different from child support.

The relevant sections pertaining to spousal maintenance can be found in the Family Law Act in sections 72 and 75.

Eligibility for Spousal Maintenance

If a party cannot support himself or herself, an application to court can be made for spousal maintenance. Considerations include the following:
  • Whether there is a child of the marriage under 18
  • Whether the applicant has a disability and, as a result, cannot obtain gainful employment 
An application for spousal maintenance can be made as part of a property settlement application but does not have to be.
