What is Conveyancing?


The term conveyancing refers to “the act of performing the various functions relating to the transfer of real property.”

Simply put, it is the process by which the ownership of a property is changed. The most common form is the purchase and sale of land and house. It also includes transferring part of the ownership of a property, transferring property pursuant (due to a marriage breakup) and the gifting of property through a will.

The buyer and seller sign a contract and the parties become bound. The contract will often be subject to a number of conditions that, if not met, will end the contract and result in the deposit being refunded to the buyer.

Inspections

If you are buying a house, you will have to carry out a number of inspections prior to the completion of the contract. A special condition in the contract will outline the inspections to be carried out by a certain date. 

Your conveyancer will arrange these on your behalf. The inspections that are usually recommended by the conveyancer are building or engineering reports, pest and termite inspections, electrical inspections and plumbing inspections.

These inspections are carried out by qualified professionals who provide a written report, which is provided to you for consideration prior to the date specified in the contract.

Currently, in the Northern Territory, there is a no vendor disclosure. We advise that you exercise ‘buyer beware’— in other words, it is up to you to make your own enquiries. Do not rely on what the vendor or agent tells you.

First Homeowners Grant

If you have never owned residential property in Australia before, you may be eligible for a first homeowners grant to assist you in the purchase of your first home.
To be eligible for the grant, you must meet the following standards:
  • Be over 18 years of age
  • Be an Australian citizen or permanent resident
  • Have never received the grant before
  • Within one year of buying the property, move in and live on the property as your principal place of residence for at least six months
If your application is successful, you will be paid the grant at the time of settlement of your purchase. If you are obtaining finance to assist with your purchase, the grant may be paid directly to your financier. This way, your financier can provide you with the additional money upon settlement. Ask your financier for more details about payment of the grant.
